06.04.2020 – The Ministry of Economy announces that it has launched the application for the issuance of Emergency Situation Certificates on the platform http://prevenire.gov.ro. They are issued exclusively online and an electronic signature is required.

  • Government Emergency Ordinance No. 41 of 02 April 2020, for the amendment and completion of Law No. 19/2020 on the granting of days off to parents for the supervision of children in the event of temporary closure of educational establishments. 31.03.2020 –  the Government Emergency Ordinance no. 37 of March 30, 2020 regarding the granting of facilities for loans granted by credit institutions and non-bank financial institutions to certain categories of debtors has been published in the Official Gazette, through which the following important regulations were introduced:

  • For the debtors natural or legal persons, whose incomes were directly or indirectly affected by the situation generated by the COVID-19 pandemic, the obligation to pay the installments (representing capital rates, interest and commissions) related to the loans granted to the debtors by creditors up to the date of entry into force of the ordinance can be suspended, at the request of the debtor (electronic, in writing or by telephone), for up to 9 months but not more than 31.12.2020. The conditions are that the loan has not matured and the creditor did not declare the anticipated maturity of the loan prior to the entry into force of the ordinance. 

  • The interest accrued during the suspension period will be added to the principal debt and will be paid within the post-termination rates. This means that, after the suspension period, the payment of both capital and interest on unpaid rates will be made in installments over the rest of the credit period.

  • By exception, for the mortgage loans contracted by natural persons, the interest related to the period of suspension will be calculated according to the provisions of the credit agreement and will represent a distinct and independent debt in relation to the other obligations arising from the credit agreement. For this debt, the interest will be 0% and the payment by the debtor will be made in installments, in 60 equal monthly shares, starting with the month immediately following the end of the deferral period. Only with regard to these interests, the payment will be 100% guaranteed by the Romanian state, through the Ministry of Public Finance.

– Government Emergency Ordinance no. 32/2020 on the modification and completion of the Government Emergency Ordinance no. 30/2020 for the modification and completion of some normative acts, as well as for establishing measures in the field of social protection in the context of the epidemiological situation determined by the spread of SARS-CoV-2 coronavirus and for establishing additional social protection measures, by which the requirements of Ordinance 30/2020 that employers had to comply with in order for their employees to benefit from the 75% allowance (i.e. holding an emergency certificate or reducing their income by 25%) are repealed. The only condition remains the following: the employers “temporarily reduce or discontinue the activity in whole or in part as a result of the effects of the SARS-CoV-2 coronavirus epidemic, during the state of emergency declared, according to a declaration on their own responsibility”. 26.03.2020 –  the Order 791/2020 of the Minister of Economy regarding the issuing of emergency situations certificates to the economic operators whose activity is affected in the context of the SARS-CoV-2 pandemic has been published in the Official Gazette. According to it, starting March 31th, two types of emergency certificates can be obtained exclusively online, through the http://prevenire.gov.ro, which is active from 06.04.2020 platform: 

1. Blue – issued for the applicants requesting its granting based on the declaration on their own responsibility from which results the total or partial interruption of the activity, following the decisions issued by the competent public authorities during the state of emergency.

2. Yellow – issued for applicants requesting its granting based on the declaration on their own responsibility from which results the recording of a decrease of the receipts in March 2020 with a percentage of at least 25% compared to the average of the receipts from January – February 2020. 

Both certificates can be used in relations with public institutions to obtain facilities / support measures or in commercial relations, but an applicant may only request the issuance of a single type of emergency certificate.

The certificates will be issued automatically, electronically, after the validation by the system of the request and only during the period of maintaining the state of emergency in Romania. The certificates will be valid without signature and stamp, based on the series and number identifiable in the database of the site.

21.03.2020 – Emergency Ordinances 29/2020 regarding some economic and fiscal-budgetary measures and 30/2020 for amending and supplementing certain normative acts, as well as for establishing measures in the field of social protection in the context of the epidemiological situation determined by the spread of the SARS-CoV2 are published, as well as the Government Decision 217/2020 for the application of the provisions of Law no. 19/2020 regarding the granting of free days to the parents for the supervision of the children, in the situation of temporary closure of the educational units. 19.03.2020- In view of the information provided by the Government of Romania through the online platform, section Communiqués and documents of the government meeting(accessible at https://gov.ro/ro/guvernul/sedinte-guvern/informatie-de-presa-privind-proiectele-de-acte-normative-adoptate-sau-de-care-guvernul-a-luat-act-in-edinta-din-18-martie), in order to adopt measures necessary to apply the provisions of Decree No. 195/2020 regarding the establishment of a state of emergency in the territory of Romania, the Government adopted on the night of March 18, the Emergency Ordinance to amend and supplement certain normative acts, as well as to establish measures in the field of social protection in the context of the epidemiological situation determined by the spread of the SARS-CoV-2 coronavirus.

We mention that the Ordinance has not yet been published in the Official Gazette and therefore it has no effect, but we are constantly checking the latest issues of this publication and we will keep you updated as soon as this happens.

18.03.2020 – The Strategic Communication Group decided yesterday, March 17, at 22.00, in a meeting of the management, to impose new general measures, valid on the national territory, to prevent the spread of the new type of coronavirus. By military ordinance, in order to impose these measures, the following decisions were taken: 

  • The activity of serving and consuming food and alcoholic and non-alcoholic beverages is suspended, organized by restaurants, hotels, cafes or other public places, in the spaces intended for this purpose inside or outside the location.

  • The economic units running activities of commercialization of food products and alcoholic and nonalcoholic drinks are allowed to perform activities that do not suppose clients to stay in the spaces destined for this purpose, like those of type “drive-in”, “room-service” or delivery to the client.

  • All cultural, scientific, artistic, religious, sports, entertainment or gambling, spa treatment and personal care activities, held in confined spaces, are suspended.

  • It is forbidden to organize and conduct any event involving more than 100 people, in open spaces.

  • The organizers of the events held in open spaces, which involve the participation of a maximum of 100 persons, are obliged to take measures to ensure a distance of at least 1 meter between the participants.

  • Drivers of freight vehicles with a maximum authorized capacity greater than 3.5t have the obligation, at the border crossing point, to have on them and to wear individual means of protection, such as disinfectant, gloves, face mask and to present documents attesting the route of travel to the destination.

  • The assemblies and subassemblies of medical equipment manufactured in Romania for beneficiaries from outside the national territory are not subject to export restrictions.

  • All flights by airline operators to Spain and from Spain to Romania are suspended, for all airports in Romania, for a period of 14 days. The measure takes effect from 18.03.2020, 18.00, Romania time.

  • The measure of suspension of flights performed by airline operators to Italy and from Italy to Romania is extended for a period of 14 days, starting with March 23, 2020. These measures do not apply to flights performed by state aircraft, to freight flights. and correspondence, humanitarian or providing emergency medical services, as well as non-commercial technical landings.

16.03.2020– The President of Romania signs the Decree no. 195/2020 establishing the state of emergency, with immediate applicability and for 30 days. It imposes both measures with immediate applicability, as well as measures that will be applied gradually, through subsequent decisions, depending on the evolution of the epidemic. Among the measures that are enforced immediately: 

  • companies with private capital, are obliged to introduce, where possible, the work at home/telework regime, by unilateral act of the employer;

  • The controls performed by the Territorial Labor Inspectorates on employers are suspended

  • Central public authorities may requisition material production units and equipment needed to combat this epidemic

  • The Ministry of Economy, Energy and Business Environment issues, upon request, to economic operators whose activity is affected in the context of COVID-19, emergency situation certificates based on the supporting documents

  • The limitation periods of any kind do not start to be counted and, if they started to run, they are suspended during the entire state of emergency During the state of emergency, the activity of trial continues only in cases of special urgency, the trial of civil cases being suspended during this time without being necessary to carry out a procedural act in this regard

  • The foreclosure procedure continues only in cases where it is possible to comply with the sanitary discipline rules established by the decisions of the National Committee on Special Emergency Situations, in order to protect the rights to life and physical integrity of the participants involved

14.03.2020– The Strategic Communication Group within the Ministry of Health confirms Romania’s entry in scenario 3 of the epidemic (the existence of a number between 101 and 2000 of confirmed cases of Covid-19), meaning “the sustained transmission on a large scale, with increasing pressure on the health care system”. It is necessary to restrict the cultural, scientific, artistic, religious, sporting and entertainment activities, which involve the participation of more than 50 persons, performed in closed spaces, including those performed in spa treatment rooms, fitness rooms, SPA salons, cosmetics, gambling halls and casinos. 11.03.2020- The National Committee for Special Emergency Situations issues an order comprising the temporarily suspension, for a period of 6 months, of the distribution, outside the territory of Romania, of medicines, medical devices and essential health materials in the prevention and treatment of the conditions associated with COVID- 19. The list includes sanitary materials and medical devices such as: suits, gloves, syringes, masks, goggles, disinfectant solutions, as well as other medical materials and devices identified to be necessary for the management of COVID-19 cases. 09.03.2020- The National Committee for Special Emergency Situations decides to suspend flights and road / rail transport of persons to and from Italy. The air operators have the obligation to communicate to the Romanian citizens who will embark from Italy, China, Iran or South Korea to Romania the fact that, once arrived, they will be quarantined and will assume this responsibility by completing a declaration on their own responsibility to boarding the aircraft. Those who come from the four mentioned states and enter the country through the land border points are obliged to enter the border county quarantine or in isolation at home. For events with a maximum number of 200 participants, it is not necessary to request the opinion of the public health directorate. 08.03.2020– The Ministry of Health prohibits, until March 31, 2020, activities involving more than 1,000 people, for all public and private agencies. The events for which the participation of a smaller number of persons is estimated can only be organized after obtaining the approval from the local Public Health Departments. 04.03.2020– The meeting of the National Committee for Special Emergency Situations takes place, in order to analyze the situation regarding the confirmed cases of infection with the new coronavirus, but also to arrange the necessary measures to combat the spread of the virus. 4 scenarios for the evolution of the epidemic are approved: scenario 1- from 1 to 25 confirmed cases of infection, scenario 2 – from 26 to 100 cases, scenario 3 – from 101 to 2000 cases of coronavirus infection , scenario 4 – over 2,001 cases of illness.Bulletin available athttps://www.mai.gov.ro/informare-covid-19-grupul-de-comunicare-strategica-ora-17-00/

02.03.2020- The Romanian authorities have decided that the Emilia-Romagna region of Italy, South Korea and Iran should be included in the list of areas for which the measure of self-isolation at home is established for a period of 14 days in the case of Romanian citizens returning to Romania from these regions.
